What are statutes of limitations? A statute is a common law that sets forth the maximum time period after certain events such as a wrongful death that legal proceedings may be initiated.
Attorney fees limited to 1/3 of award to plaintiff
Caps on damages – Tennessee Statute of Limitations Laws
Medical Malpractice—For causes of action arising in tort, the state shall only be liable for damages up to the sum of three hundred thousand dollars ($300,000) per claimant and one million dollars ($1,000,000) per occurrence
Product Liability – Tennessee does not limit damages in product liability cases

For Statute of Limitations
- Negligence - 1 yr statute of limitations. Statute begins to run from the time client discovers or should have discovered, the negligent act
- Medical Malpractice – Against health care providers = within 1 yr. of date of injury or 1 yr. from date of discovery; may not file more than 3 yrs from date of negligent act. Actions based on insertion of foreign object = must be brought within 1 yr. after wrongful act is or should have been discovered.
- Product Liability – 1 year after suffering injury
- Wrongful Death – 1 year after date of death
- Survival – 1 yr after suffering injury
Except in cases of wrongful death, the statute of limitations begins to run on the minor's 18th birthday;
