Caps on damages – Rhode Island Statute of Limitations Laws

Medical Malpractice— Rhode Island does not limit damages awards in medical malpractice cases.

Product Liability - Under Rhode Island law, party seeking award of punitive damages bears burden of providing evidence of such willfulness, recklessness, or wickedness on part of party at fault as amounts to criminality, for which good of society and warning to individual should be punished. It is question of law for trial court to decide whether plaintiff's proof supports award of punitive damages, and only if court determines that facts of case warrant such award should it allow jury to decide amount of that award.

The same as above applies to pharmaceutical cases.

For Statute of Limitations

  • Negligence - 3 yrs. after suffering injury
  • Medical Malpractice -Against health care providers = within 3 yrs. of date of injury OR when injury was or should have been discovered.
  • Product Liability – 3 years after suffering injury
  • Wrongful Death – 3 years after date of death
  • Survival – 3 years

Minors = Except in the case of medical malpractice or wrongful death, the statute of limitations begins to run on the minor's 18th birthday
