An Ohio jury awarded a woman $3 million in a wrongful death lawsuit that killed her husband in 2005. (See: http://www.recordpub.com/news/article/3154141)Her 58-year-old husband was working alone during a midnight shift at a fabrication plant. He became trapped in a laser-cutting machine and died. The husband tried to make an adjustment to the machine when he became trapped. He suffered injuries to his pelvis and chest and died from compressional asphyxiation.
The company was held responsible because the employee worked alone without access to help if he needed it.
The trial was not a long one and the jury awarded $2 million in compensatory damages, with $100,000 for the husband's pain and suffering from the time of injury to the time of his death; $400,000 for pecuniary damages; and $1.5 million to the widow for loss of consortium and her husband's wrongful death. Another $1 million was awarded in punitive damages.
