Out of Court Wrongful Death Accident Lawsuit Settled

A widow filed a wrongful death lawsuit when her then husband fell through the roof a Georgia Pacific building in 2002. (See: http://www.dothaneagle.com gulfcoasteast/dea/local_news.apx.-content-articles-DEA-2008-01-17-0009.html)

The husband was working for acontractor when he fell through the roof of an old building. He was hired to replace a portion of the roof when he fell through a piece of tin and died.

The wrongful death lawsuit was filed against the contractor whom the husband worked for, and Georgia Pacific, two different companies. The contractor was removed as a defendant.

The argument was that Georgia Pacific was at least partially responsible for the husband's death because it did not follow its own safety procedures dealing with workers on roofs and working conditions.

The contractor was hired to remove and replace about 8,000 square feet of the roof. The company had been working on the roof four days when the accident occurred. It was husband's first day on the roof.
The case went into mediation and the wrongful death lawsuit was settled shortly thereafter; terms of the settlement were confidential.
