Lack of School Policy May Have Been the Cause of Wrongful Death

A 7th grade boy in Ohio died in 2003 from injuries he sustained in a car accident. (see: http://zanesvilletimesrecorder.com /apps/pbcs.dll/article?AID=/20080113/NEWS01/801130303/1002) The boy was ejected from the car as it veered off the road and hit an embankment. A 17 year old boy was driving.

Employees at the middle school allowed the 17 year old boy to remove the 7th grader from the school grounds without permission from boy's parents and subsequently the accident happened causing the boy's death. The wrongful death lawsuit says that the boy should not have been in the company of the 17 year old.

According to the family's attorney, "The school could have had a policy in place for accountability of which child got on an assigned school bus and who didn't."

Other school districts have policies and head counts that insure the school administrators know which child is arriving at school and which is leaving on the proper transportation.

The Fifth Appellate District determined that the lawsuit can go forward to trial due to the fact that the statute of limitations of when a lawsuit can be filed again after being voluntarily dismissed was extended,
