In Pennsylvania, the statute of limitation for a wrongful death, personal injury, product liability, and medical malpractice lawsuit is two years.

What is statute of limitations? A statute of limitation is a common law legal system that sets forth the maximum time period after certain events such as a wrongful death that legal proceedings may be initiated.

Statutes of limitations are predicated by fairness. Statutes of limitations provide closure which encourages courts and law enforcement agencies to handle lawsuits in a timely manner.

What are the statutes of limitations in Arizona? Think in twos:

2 years for negligence; 2 years from date of injury for medical malpractice, 2 years for product liability, 2 years for wrongful death / date of death, and 2 years for survival
What are cap damages?

• Caps on damages for Medical Malpractice: Constitution prohibits enactment of laws limiting damages for death or personal injury or abrogating causes of actions for injuries and bars trial judges from directing verdict based on contributory negligence or assumption of risk. A.R.S. Const. Art. 2, § 31
• Caps on damages for Product Liability: Constitution prohibits enactment of laws limiting damages for death or personal injury or abrogating causes of actions for injuries and bars trial judges from directing verdict based on contributory negligence or assumption of risk. A.R.S. Const. Art. 2, § 31
• Caps on damages for Pharmaceutical Cases:  See damages for medical malpractice and product liability.

Are there any caps on attorney awards?  Attorney awards are not limited, but the court may review reasonableness of fees upon request of either party.

What are the restrictions for minor’s tolling? Except in cases of wrongful death, a minor must file a lawsuit within two years of his or her 18th birthday.
