Wrongful Discharge and Your Rights

Wrongful Discharge Attorneys

The act of Qui Tam, the act of an employee filing a legal case against a government contractor who is misusing government funds, has benefited the government and citizens alike. However, some of these government contractors may try to terminate an employee that turns them in. It is wrong, it mars the whistleblower’s employment history, and, most important of all, it is illegal. Though an employer can give a number of reasons for terminating an employee, not all are viable. Wrongful discharge based on gender, race, and age issues is illegal. The same situation goes for those involved in Qui Tam lawsuits. Receiving harassment for turning in your employer is against the law.

“A Qui Tam filer who feels he is being treated in a demeaning manner or is facing wrongful termination can contact an attorney that specializes in wrongful termination and Qui Tam cases."

Fortunately for whistleblowers, the government has provided rights, which they can fall back on. When the government amended the False Claims Act in 1986, they realized that employers could attempt to retaliate against employees that turned them into the government for misuse and/or unlawful acquisition of government funds. The act, along with making turning in fraudulent business dealings easier, protected employees from retaliatory demotions, loss of pay, wrongful discrimination, and wrongful termination.

The False Claims Act states that "Any employee who is discharged, demoted, suspended, threatened, harassed, or in any other manner discriminated against in the terms and conditions of employment by his or her employer because of lawful acts done by the employee on behalf of the employee or others in furtherance of an action under this section… shall be entitled to all relief necessary to make the employee whole."

The False Claims Act provides whistleblowers with many legal protections the whistleblower can use in the event of wrongful termination. These compensations can include reinstatement back to your previous job, double payback for time lost, and compensation for personal damages and attorney fees. Some states have additional wrongful termination laws that courts can impose.

However, employers that commit these unlawful acts are likely not willing to cooperate with the employee. A Qui Tam filer who feels he is being treated in a demeaning manner or is facing wrongful termination can contact an attorney that specializes in wrongful termination and Qui Tam cases. This attorney will be able to determine if you have a case that will hold up in court.
