Whistleblower Laws
Anytime an individual finds that their employer or group that they work with is in violation of the False Claims Act, that individual has the right to come forward. If they do come forward and they are the first to do so with their claims, then they are considered a whistleblower and there are laws that protect this individual. Why does this person receive protection? They receive protection because they are revealing fraudulent activities that have been intentionally committed in order to defraud the government out of money or property. Either way, those committing the fraud are defrauding taxpayers since it is the taxpayers that make up the income of the United States.
When a whistleblower blows the whistle on activities that legitimately violate the False Claims Act, federal law says that that individual has to be protected. Federal law also states that the individual has to be protected even if their case never sees the courtroom. Federal law states that these individuals must be reinstated and maintain a position of seniority, receive any damages that they may be entitled if they had to encounter any discriminatory treatment, must receive twice the back pay in wages, must receive interest on that back pay, and be reimbursed any attorney fees or other costs incurred due to the lawsuit.
If the whistleblower returns to work and finds that they have been demoted, is suspended, is fired, is harassed, or abused in any way, they can file a complaint within 45 days of those alleged activities. If the employer is found guilty, then they have to pay the price. They are in violation of federal law and the whistleblower laws that have been set aside by the False Claims Act to keep such atrocities from occurring.
