What is the Deadline for Filing a Qui Tam Action?

When you are privy to information that lets you know fraud has taken place against the government, you will be able to file a lawsuit on the government's behalf. The Qui Tam statute of limitations is set forth in the False Claims Act. As long as you are able to follow the Qui Tam deadline, you'll find that your filing goes very smoothly and that you are better able to finish up your lawsuit and receive your compensation. The Qui Tam deadline is dependent on the type of case that you are filing, and on the specifics of the case. A Qui Tam lawyer can give you an exact estimate of the deadline. However, the False Claims Act does lay out a timeline for you.

Under the false claims act, you must file the Qui Tam action within the later of two time periods. First of all, you must file within six years of the actual violation of the act. This means that when the act was first committed, you will have six years to file the Qui Tam lawsuit. The second time frame is also important. Along with filing within 6 years of the violation taking place, the Qui Tam statute of limitations specifies that the filing must be done within three years of the time in which the government should have known or did know about the violation. This cannot be in any event longer than ten years after the violation of the act.

Therefore, you either have to file within 6 years of the violation of the act, or with 3 years of the time that the government should have known of the violation – up to 10 years after the violation. It can be tricky to discern when the Qui Tam deadline is for your particular case because of this.
