The Flu

Flu Attorneys

Are adults who think that they have been injured after receiving trivalent influenza vaccines eligible to file claims with the National Vaccine Injury Compensation Program (VICP)? Yes. Either a child or an adult who receives a trivalent influenza vaccine in the U.S. within the applicable time limits would be eligible to apply for compensation under the VICP.

What is the trivalent influenza vaccine? Simply, it is "the Flu Shot". This influenza vaccine is given annually during the influenza season. It contains three vaccine virus strains which are thought most likely to cause disease outbreaks. There are two types of annual influenza vaccines routinely given to millions of individuals in the United States during the flu season. One is an inactivated (killed) virus vaccine administered using a syringe, while the other is a live, attenuated product administered in a nasal spray.

Serious side effects from the flu vaccine include life-threatening allergic reactions within a few minutes to a few hours after the shot. In 1976, swine flu vaccine was associated with a severe temporary paralytic illness called Guillain-Barré Syndrome (GBS). Influenza vaccines since then have not been clearly linked to GBS, although research suggests a small risk of the syndrome was associated with the influenza vaccines in 1992-1993 and 1993-1994. However, if there is a risk of GBS from current influenza vaccines, it is estimated at 1 or 2 cases per million persons vaccinated . . . much less than the risk of severe influenza, which can be prevented by vaccination.

Flu Vaccine Side Effects and What to do?

Different side effects can be associated with the flu shot. The flu shot viruses are killed (inactivated), so you cannot get the flu from a flu shot. However, on rare occasions, flu vaccination can cause serious problems, such as severe allergic reactions, stroke, brain damage, encephalopathy and/or coma.. As of July 1, 2005, people who think that they have been injured by the flu shot can file a claim for compensation from the National Vaccine Injury Compensation Program (VICP).
