CDC Data shows that More than 33 percent of adults 65+ will fall this year. Falls are the leading cause of injury deaths. Older people who suffer from slip and falls suffer bruises, head traumas, and hip fractures making it difficult for older adults to live independently. Falls are the most common cause of traumatic brain injuries.

People who fall but may not be injured develop a fear of falling which limits their activities.

Men are more likely to die from a fall but women are more likely to have a nonfatal slip and fall injury. Women have more hip fractures than men.

The risk of being seriously injured in a fall increases with age. People 75 and older who fall are four to five times more likely to be admitted to a long-term care facility for a year or longer.

How can older adults prevent slip and fall injuries?

Older adults should exercise regularly to increase strength and balance; reduce prescriptions that cause dizziness; have their vision checked once a year; improve home lighting; and reduce home hazards that can lead to falls like slippery throw rugs and leaving lower drawers and cabinets open.

Slip and Fall Case over Floor Mat

The plaintiff says she was working at the Motomart, when she tripped over a floor mat causing permanent injuries to her right knee.

According to the plaintiff, Aramark supplied, delivered, inspected and cleaned Motomart's floor mats. She claims Aramark had previously been notified by customers that its floor mats would curl or become wavy which caused a slip and fall injury hazard. According to the plaintiff, Motomart informed Aramark that it should not deliver defective mats to this store.

"Aramark tested the mats at issue and acknowledged that the curling edge issue was caused by the mats adversely reacting to Aramark's wash formula," said the plaintiff. She claims Aramark was negligent and claims her knee injury has caused her to sustain great pain and suffering, medical expenses, and lost wages.

Aramark Uniform Services removed a Madison County civil complaint to federal court in East St. Louis arguing that there is a complete diversity of citizenship between parties.

Aramark denies negligence and argues that the plaintiff's injuries were either caused or contributed to be caused by her own negligence, fault, or assumption of risk.

Woman Sues after Slip and Fall

A West Virginia woman filed a lawsuit against the local transportation company after a slip and fall on water that had accumulated on a bus.

According to the slip and fall lawsuit, the bus she was riding came to a stop. As she got up and moved toward the exit, she allegedly slipped on an accumulation of snow and water in the aisle. The victim fell, fracturing her left leg.

She claims the bus company was negligent in maintaining the bus in a safe manner. According to the lawsuit, she suffered physical pain and mental and emotional anguish. She seeks compensatory and punitive damages.

Slip-and-fall suit against PennDOT

The state Supreme Court has agreed to hear the state attorney general's appeal of a Commonwealth Court decision allowing the plaintiff in a slip-and-fall suit against PennDOT to proceed even though the agency was not named in the caption of the complaint.

Arguments pro and con ensued as to the legality of the issue.

What the plaintiffs is named an agency in the body of the complaint without properly naming the agency in the caption. Now state agencies have to examine every complaint in grave detail to determine if they have liability.

Since the commonwealth is always a distinct and separate legal entity, the naming of the commonwealth in the caption of the complaint instead of a commonwealth agency is always the naming of the wrong party and never merely a technical defect.
