Anapol Schwartz partners Alan Schwartz and Stephen Pokiniewski initiated a Medical Malpractice action against a local hospital and area physicians following the untimely death of a seventy-three year old man hospitalized for a routine urological procedure.After the elective procedure, the deceased experienced significant complications traceable to a prior surgery and unrelated to the present admission. Failure on the part of the treating doctors and the hospital staff to recognize and address obvious vascular problem Plaintiff's husband requiring amputations and developing infections and respiratory complications that ultimately led to his death six weeks following his admission to the hospital.
Claims were brought on behalf of the deceased's estate and his spouse who herself suffered severe emotional trauma after being constantly present at the hospital throughout her husband's medical treatment and observing his sub-standard care. After a lengthy discovery process and identifying eight expert witnesses, the case went to trial. Following two days of trial that included jury selection and opening statements, a settlement was reached for $2.2 million dollars.
