Anapol Schwartz partners Alan Schwartz and Stephen Pokiniewski initiated a medical negligence action against a local hospital and area physicians following the failure to diagnose a tumor on a juvenile's pituitary gland. After being treated at the same hospital and pediatric group for many years with signs and symptoms of a serious endocrine disorder, minor plaintiff was finally diagnosed with a pituitary tumor. Unfortunately, due to the delay in diagnosis, he suffers from significant long-term medical problems, including diabetes, obesity, vision problems, headaches and failure to achieve puberty.
Claims were brought on behalf of the child and his parents. After a lengthy discovery process, including the retention of medical experts from a wide range of specialties, the case was set for trial. Just before the case was scheduled to commence, extensive settlement negotiations led to a $6.1 million dollar confidential settlement.
