Real Facts About Medical Malpratice Litigation

Once again when the facts are analyzed (and not just stories meant to mislead, inflame and deceive), they indicate that there is no evidence of a "medical malpractice crisis." The evidence indicates that between 1985 and 2005 there was no increase in the number of medical malpractice lawsuits filed on behalf of children against pediatricians.

As reported in the Medical News Today the July issue of the journal Pediatrics published a comprehensive retrospective analysis of claims brought against pediatricians from 1985 to 2005. The author of the study concluded that there is no basis to claim there is a malpractice crisis involving pediatricians. The number of lawsuits filed against pediatricians has not increased over the past 20 years (1985 to 2005). Moreover, approximately 75% of the cases filed were withdrawn, dismissed or resulted in a verdict for the defendant.

These "real" facts about litigation highlights that the propaganda by insurance companies and big corporations that Americans are overly litigious are simply not true. Also given the complex nature of medical negligence litigation, consumers need to be represented by attorneys very experienced in handling these types of cases. Anapol-Schwartz attorneys have successfully represented numerous victims of medical mistakes for over 40 years.
