Lead Paint

Lead Poisoning Attorneys

One particular category of toxic tort is injuries caused by exposure to lead-based paints.

The hazards of lead-based paints have been widely known since the early 1900s, when the use of lead in making paint was banned in Australia. It wasn't until 1978 though that the use of lead in the manufacture of paint was banned in the United States. Lead has also been found in vinyl mini-blinds and in the finishing on fixtures such as bath tubs.

The greatest danger of injury from lead is to children under the age of seven, who are still in the developmental stages of life, and whose brains and bodies are sensitive to even small amounts of lead. These injuries can be severe and can prevent children from achieving success in scholastic, vocational and other areas, as well as their abilities to function as independent adults.

While there are many sources of lead in a child's environment, it is widely known that the most common cause of lead poisoning for children comes from chipping and peeling lead-based paint used in residences. When lead-based paint deteriorates, it chips and flakes, eroding to small pieces that children can easily ingest, and also forms dust that can be easily ingested by children putting dusty items in their mouths.
