The Industry Knows Better... And Could Stop Dangerous Foam Fires

Although most consumers don't realize the danger of polyurethane foam, it has been known to the furniture industry and the federal government for decades.

NIST Data Reveals The Extent of This Danger

According to the federal government's National Institute of Standards and Technology, polyurethane foam in furniture is responsible for 30 percent of U.S. deaths from fires each year. Yet the furniture industry has failed to regulate itself, and in fact fights attempts to require flame-retardant treatments or other changes that would make furniture safer. In most states, strict flammability standards for furniture only exist for public facilities, such as hospitals, airplanes and prisons. Only one state, California, has adopted strict flammability standards for furniture sold to consumers; the federal government does not have flammability standards for furniture other than mattresses. Ironically, in most of our country, prisoners are less likely to die in a furniture fire than ordinary citizens.

Flammable Couch Lawsuits
In a lawsuit over a house fire caused by a flammable couch or other furniture, the plaintiffs -- those who filed the suit -- must show that the fire was partially caused by the furniture's unsafe level of flammability. Then, the plaintiffs must show that the manufacturer of the furniture knew or should have known that the furniture was unsafe, but offered it for sale anyway. If another person or persons contributed to the cause and severity of the fire, more than one party may be a defendant. Plaintiffs will also have to show the jury what kind of damages they suffered as a result of the fire, including burn and smoke inhalation injuries; loss of home and property; medical bills; pain and suffering; and wrongful death.
