New York Car Seat Laws New York requires children age 6 and under to ride in a federally approved car seat or booster seat that is appropriate for the child's height and weight. New York recommends, but does not require, that children remain in a booster seat until they can safely use a lap/shoulder belt with their back against the seat and knees bent, where the lap belt sits low across the hips and the shoulder belt doesn't touch the neck or face.
