Delaware Car Seat Laws Delaware's child passenger safety law requires that children under age 6 and under 60 pounds be properly restrained in an approved car seat appropriate for the child's age, weight, and height. Children ages 7 to 15 must be buckled in a seat belt. Also, Delaware requires that children under age 12 or under 65-inches-tall sit in the back seat if there is an active air bag in the front passenger seat.
