The illegal tissue harvesting lawsuit, filed in the New York state Supreme Court, claims that Biomedical Tissue Services did not obtain permission before recovering body parts from the remains of Bart W. Hamilton, who died in Rochester in February 2005. The lawsuit also alleges in legal papers that Profetta Funeral Chapel allowed Biomedical Tissue Services to undertake the improper tissue collection. Profetta operates funeral homes in Irondequoit and Webster, New York. Biomedical Tissue Services, which took tissue from cadavers in funeral homes and sold it for use in medical procedures, ceased operations a year ago after allegations of impropriety surfaced.
