Bicycle Crashes in PA? Who Has the Right of Way?

Riding a bicycle can be a fun, healthy, and economical way to travel.  However, in order to share the road safely with cars, trucks and pedestrians it is important to understand who has the right of way in Pennsylvania.

Pennsylvania law is clear about bicycles and the right of way.  Title 75, Chapter 35 Section 2501 of the Pennsylvania General Statutes provides that : “Every person riding a pedalcycle (bicycle) upon a roadway shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle….”

In other words, a bicyclist has to obey the same laws as car and truck drivers and is subject to the same right of way laws.  Yet, while cars do not have to yield the right of way to bicyclists, both bicyclists and motor vehicle drivers need to yield the right of way to pedestrians, pursuant to Pennsylvania law.
