Q. Who Has the Right of Way in PA?
A. In order to share the road safely with cars, trucks and pedestrians it is important to understand who has the right of way.
Pennsylvania law is clear about bicycles and the right of way. Title 75, Chapter 35 Section 2501 of the Pennsylvania General Statutes provides that : “Every person riding a pedalcycle (bicycle) upon a roadway shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle….”
Q. What is considered a bicycle accident?
A. A bicycle accident is any accident between an automobile and a bicyclist. Since bicycles are considered vehicles they do not have the privilege of “right of way” as a pedestrian does. A bicycle must follow all vehicle codes and laws as any other automobile on the roadway.
Q. Are there special laws for bicyclists?
A. Yes. Along with the vehicle code a bicyclist must also follow certain laws that pertain only to bicyclists. These laws can be found on our Bicyclist Laws and Rights page by clicking here. These laws have not been edited and are a direct copy of what is written in Pennsylvania law books. The laws cover everything from rider safety, parking and rider responsibilities.
Q. Who will pay for my medical bills if I am injured in a bicycle accident?
A. Since a bicycle is considered a vehicle, a bicyclist must follow the same procedures as an automobile driver when involved in an accident. Both parties are required to exchange automobile insurance information to file claims accordingly.
