People who were hurt by using Avandia began pursuing legal action within weeks of the news that Avandia is associated with a serious risk of heart attacks and heart disease-related death. These personal injury lawsuits claim that the plaintiffs had heart attacks or developed heart failure, primary pulmonary hypertension or other very serious heart problems by using Avandia on their doctors’ advice. Families that lost a loved one to a health problem they believe was caused by Avandia also filed wrongful death lawsuits. They also point to strong evidence that Avandia manufacturer GlaxoSmithKline knew about these problems well before they were made public, but did not disclose them, in order to continue receiving billions of dollars a year in Avandia revenues.
While it’s difficult to say how many Avandia claims have been filed, legal observers believe that there may be thousands of active cases in the United States alone. More may be filed in Europe, Canada and other areas where the world’s seven million Avandia users live. And attorneys are already looking into launching an Avandia class-action lawsuit, which combines thousands of lawsuits brought by people in similar situations, allowing them to pool their resources and recover substantially more money from GlaxoSmithKline than they may have been able to as individuals. These lawsuits seek to take Avandia off the market, win compensation for their physical, financial and emotional injuries, and hold GlaxoSmithKline legally responsible for withholding important safety information from patients.
