When the negligent driver dies, can the other driver sue the estate?
If you have been hurt by a negligent Pennsylvania driver who has died then you are in an interesting position. You have, after all, suffered because of the negligence of someone else and you may have incurred costs such as lost income, medical expenses, out of pocket expenses and pain and suffering. You shouldn’t have to bear the burden of those expenses.
Yet, the person who caused your injuries has died. Do you have the right to sue the driver’s estate even though it is the estate’s beneficiaries, not the negligent driver who will bear the financial cost?
In Pennsylvania, you can sue the estate of the negligent driver for damages such as pain and suffering, out of pocket expenses, and wage loss. You can also sue for medical expenses in excess of the amount your own medical insurance will cover.
