Anapol Schwartz recently settled a lawsuit with General Motors (GM) for a confidential amount in which the front airbags on a 2003 Chevy Trailblazer failed to deploy in a single car accident with a tree. The impact speed was approximately 25 mph. Had the airbags deployed the driver of the Chevy Trailblazer could have been spared catastrophic injury involving brain damage.
GM contended that the airbags were not designed to deploy in the accident; that the driver of the Chevy Trailblazer was not wearing her seatbelt; and even if the airbags would have deployed they wouldn’t have prevented the catastrophic injury to the driver.
In 2006 Mark LeWinter won a $14 million settlement for a 26-year-old roofer who suffered a debilitating spinal injury when he fell without the protection of a falling harness. Although not paralyzed, the plaintiff lost his sexual functioning as well as bladder and bowel control.
